Picking An Attorney For Your Unique Real Estate Needs

Anyone who meets their real estate goals may find themselves in need of a real estate attorney. If that is you please remember that each real estate transaction is is unique. I can't stress that enough. As a real estate agent who has been working the business for 4 years I know first hand that real estate is a crazy emotional ride for all those involved. 

Hiring an attorney is not something that should be taken lightly. Which is why I want to focus this blog post on that very topic....Attorneys. 

There are tons of legal issues that can occur and put a hiccup in any transaction. Even one that seems like it will be a piece of cake. And with all that is at stake I suggest picking the right attorney.  And being that real estate transactions are typically the single largest asset for many people hiring the right attorney is key to overcoming or at the very least dealing with any obstacle that may arise. 

Hiring an experienced attorney is key to getting the results that all parties want.

Something to keep in mind is what kind of transaction you are going to be involved in....for instance is it one of the following:

  • Residential

    • And within residential make sure your attorney is well versed in the type of residential property you are engaging in (i.e. Single Family, Condo, COOP, Multi-Family, New Construction, Historic Homes, Foreclosure, Bank Owned and so forth)

  • Landlord/Tenant

  • Commercial

  • Or whatever

And keep in mind just because you hire a real estate attorney that does not mean your homework in making sure you are hiring the attorney is done. There are real estate attorneys that specialize in contracts and others that specialize in transactions. It is wise to find out if your attorney deals more with lawsuits or transactions. For instance a landlord may need to hiring an attorney that is a litigator versus a transaction attorney. And a seller will want an attorney that knows how to get transactions to the closing table. 

All too often I get clients that don't do their homework because they think that any attorney can handle the sell/purchase of a home or remedy landlord/tenant disputes. But that, in my experience, is not always the case. Some attorneys will welcome the opportunity of working with a client with real estate needs.  And this can prove risky. I have seen transactions take twice as long as they should, I have seen deals fall apart and I have seen headaches arise that should not. Its the unfortunate truth. 

Something else I see is people trying to save a buck. Trust me, I get it. Purchasing a home is expensive, as is selling a home. And being a landlord or becoming a tenant also takes a pretty penny and its only natural for people to try and save money, right? Don't get me wrong, trying to save money when it comes to real estate is wise but at the same time you should pick your battles carefully. You basically get what you pay for. The norm for real estate attorney fees in my area (Lower Westchester, NY), form what I have seen is $900-$2000. I sometimes get clients that find attorneys that charge a nominal fee. And even though this may seem great that is not always the case. These attorneys may have many clients, these attorneys may have other higher paying clients (those that pay tend to more may get more attention from their attorney). I also hear and see situations where an attorney has too many clients and they seem overwhelmed. 

Finding an attorney that will work hard for you is actually not that tough. Get recommendations. Do your homework and chances are you will be pleased. Remember each transaction is unique and hiccups may develop...and that is okay. Stay calm. Communicate with you attorney and know there are plenty of wonderful, hard working, honest attorneys out there.  I know this because I have worked with many and I know I will continue to work with and meet more.
